SAN DIEGO April 26, 2018

The San Diego labor law attorneys at Blumenthal Nordrehaug Bhowmik De Blouw, LLP, filed a class action lawsuit against Bartell Hotels Management Company, alleging that the company failed to accurately calculate and record overtime compensation for their hourly employees. Furthermore, the complaint alleges that Bartell Hotels, failed to provide mandatory meal and rest breaks to its employees. The Bartell Hotels Management Company, lawsuit Case No. 37-2018-00018400-CU-OE-CTL, is currently pending in the San Diego County Superior Court for the State of California. The class action complaint alleges that Bartell Hotels Management Company paid its employees through a non-discretionary incentive wage program, but when calculating the regular rate of pay in order to pay overtime to PLAINTIFF and other CALIFORNIA CLASS Members, DEFENDANT allegedly failed to include the incentive compensation as part of the employees’ “regular rate of pay” for purposes of calculating overtime pay. State law provides that employees must be paid overtime at one-and-one-half times their “regular rate of pay.”

Furthermore, the company's non-exempt employees were also allegedly unable to take off duty meal breaks due to their rigorous work schedules. California labor laws require an employer to provide an employee required to perform work for more than five (5) hours during a shift with, a thirty (30) minute uninterrupted meal break prior to the end of the employee's fifth (5th) hour of work. The complaint alleges that the company did not provide their employees who forfeited meal breaks additional compensation.
